- The National Labor Relations Board, or NLRB, has the obligation to enforce the National Labor Relations Act, or NLRA, including the initial processing of Unfair Labor Practice Charges, or ULPs, and the administration of Representation Elections. An election campaign by an employer must be conducted in strict compliance with applicable law, or an order to bargain, notwithstanding election results, may be issued.
- Negotiations of Collective Bargaining Agreements or CBAs take place between and employer and a certified representative of employees, or Union.
- CBAs often make provision for grievance hearings, culminating in final and binding arbitration.
- When negotiations are at an impasse, a strike may occur, or lockout imposed, under certain circumstances. Injunctions against strikes under state law are generally disallowed, unless special circumstances, usually involving picket line violence, occur.
